Just today, I was reading a great article from
about recently leaked, proposed guidelines from the U.K. Equality and Human Rights Commission (EHRC) on gender in public bathrooms. The EHRC is a public body that is supposed to oversee equality in the UK and make sure people are not being discriminated against. The leaked guidelines in question state that trans people could be banned from using single-sex spaces such as bathrooms based on how they look.
Since the Supreme Court ruling earlier this year that women are to be defined in biological terms as per the Equality Act, there has been a lot of concern over how it will apply to things such as public bathrooms. As it currently stands, public bathrooms as like virtually all public spaces, operate on a self-ID basis, believe it or not. I’m in my late 20s, for instance, and I’ve never had to provide ID to use a public bathroom, and I’ve never been scolded or transvestigated for doing so.
According to the recent leaked documents, businesses may be able to question people in single-sex spaces such as bathrooms based purely on how they look. The idea behind this is obviously that trans women are actually (in the eyes of some) men and thus they shouldn’t have access to women’s spaces…
