Rape was supposed to protect the patriarchic order of women belonging to men.
Only recently it became a thing to make it about protecting the self determination of women.

It's so recent in fact that women are not really up to the level of self determination in their life's that this judicial shift suggests.

Women are still defined by passivity.
The new approach to rape suggest that women own their lifes and their voices are heard and respected.

We all know we are not there yet.

The new book by Jen Percy gives us ample examples for that.
